INSIGHT INTO THE FORCE MAJEURE LEGAL PRINCIPLE
Pursuant to the civil unrest experienced in parts of South Africa, contracting parties are considering the implications of the force majeure principles.
Force majeure is a principle whereby a party may be freed from not performing its legal obligations in terms of a contract due to unpredicted circumstances beyond its reasonable control. These circumstances typically comprise “acts of God” varying from riots, civil unrest, fires and severe weather, among several others.

If I told you in June that COVID-19 would not be the worst peril to hit South Africa in 2021, it would admittedly be difficult to believe me. Unfortunately, the riots which for over a week engulfed the nation have swiftly removed the pandemic from the top of the list of priorities facing our country.
DRAFT DISASTER MANAGEMENT AMENDMENT BILL - OPEN TO PUBLIC COMMENT
The Parliament of South Africa invites the public to submit their comments on the draft Disaster Management Amendment Bill (a private members Bill).
Through this Bill, members of the public may comment on the following proposals:
- Extensions to the State of Disaster may only be adopted following public debate (The decision is currently at the discretion of the Minister).
- Amend the allowed duration of a State of Disaster (no more than 21 days).
- Provide that any action taken as a result of a declaration of a State of Disaster is only effective prospectively.
Comments must be submitted before 26 August, and we encourage all members to do so.

SARS - CUSTOMS SMME TRADERS & TRAVELLERS WEBINAR
The South African Revenue Service (SARS) invites all members to a comprehensive Customs SMME Traders and Travellers Clearance Procedures webinar which aims to increase compliance in accordance with Customs Clearance Procedures.
